OVERKILL YACHT CHARTERS LLC
MASTER BOOKING, CANCELLATION & OPERATING POLICY
Effective Date: February 1st, 2026
1. Booking & Payment
1.1 Payment in Full Required.
One hundred percent (100%) of the total charter fee is due at the time of booking. The total charter fee includes the selected charter duration and all elected add-ons or services.
1.2 Accepted Payment Methods.
Accepted payment methods include major credit cards, debit cards, and PayPal. A reservation is not confirmed until full payment has been successfully processed.
1.3 Final Sale.
All bookings are final and non-refundable except as expressly provided in Sections 2 and 3 below.
2. 24-Hour Booking Refund
2.1 A Charterer may cancel within twenty-four (24) hours of the original booking and receive a one hundred percent (100%) refund, provided the scheduled charter date is at least seven (7) calendar days from the time of booking.
2.2 If the scheduled charter date is fewer than seven (7) calendar days from booking, the 24-hour protection does not apply.
2.3 This provision constitutes the only guaranteed refund for guest-initiated cancellations.
3. Flexible Booking Protection (Optional – Fixed Fee)
3.1 At the time of booking, Charterer may purchase Flexible Booking Protection for the following fixed fees based on charter type:
• $399 for Half-Day (4-hour) charters
• $799 for Full-Day (8-hour) charters
• $2,999 for Multi-Day charters
3.2 Flexible Booking Protection must be purchased at the time of the original booking and cannot be added retroactively.
3.3 Flexible Booking Protection is non-refundable.
3.4 Charterers who purchase Flexible Booking Protection may cancel for any reason and receive:
• A one-time reschedule, OR
• A one-time house credit equal to the total charter amount paid,
provided written notice is received at least seventy-two (72) hours prior to the scheduled departure time.
3.5 Flexible Booking Protection may only be exercised once.
3.6 House credits:
• Are non-transferable;
• May only be used by the original Charterer;
• Do not expire;
• Are subject to current pricing at the time of rebooking;
• Do not generate refunds if the new charter price is lower.
3.7 Failure to provide at least seventy-two (72) hours’ notice voids eligibility.
4. Guest Cancellations Without Flexible Booking Protection
4.1 After the 24-hour protection window has expired, and absent the purchase of Flexible Booking Protection, all payments are strictly non-refundable.
4.2 No reschedules, credits, or refunds will be provided.
4.3 No exceptions will be made for illness, travel disruption, weather preference, or personal schedule conflicts.
5. Company-Initiated Cancellation
5.1 The Company reserves the right to cancel any charter due to mechanical issues, crew unavailability, safety concerns, harbor closures, or unsafe sea or weather conditions as determined solely by the Captain.
5.2 In such event, Charterer shall receive either:
• A rescheduled date, OR
• A house credit equal to the total amount paid.
5.3 Refunds will be issued only at the sole discretion of the Company if rescheduling is not reasonably possible.
5.4 The Captain’s determination of safety and operational conditions is final.
6. Weather Policy
6.1 Charters operate in light rain, fog, and typical coastal marine conditions.
6.2 Guest dissatisfaction with weather does not constitute grounds for refund, credit, or cancellation.
7. Force Majeure
Overkill Yacht Charters LLC shall not be liable for failure or delay in performance due to events beyond reasonable control, including but not limited to:
• Natural disasters
• Wildfire, mudslide, earthquake, flood
• Harbor closures
• Coast Guard restrictions
• Government orders
• Public health emergencies
• Fuel shortages
• Civil unrest
In such cases, Charterer shall receive a reschedule option or house credit. Refunds are not required under Force Majeure circumstances.
8. Fuel Surcharge Adjustment
8.1 Charter pricing is based on prevailing marine diesel fuel rates at the time of booking.
8.2 If Ventura County marine diesel fuel rates increase by more than fifteen percent (15%) prior to the charter date, the Company may apply a proportional fuel surcharge.
9. Capacity & Boarding
9.1 Passenger limits are governed by U.S. Coast Guard regulations.
9.2 Infants count as full passengers.
9.3 Boarding may be denied if capacity limits are exceeded.
9.4 No refund will be issued for denied boarding due to excess guests.
10. Guest Conduct & Substance Policy
10.1 Captain Authority.
The Captain maintains absolute authority over safety and conduct decisions.
10.2 Drugs.
Illegal drugs and cannabis in any form are prohibited. Violation results in immediate termination without refund.
10.3 Alcohol.
No outside alcohol permitted. Visibly intoxicated individuals may be denied boarding without refund.
10.4 Outside Food & Beverage.
No outside food permitted except for approved medical or dietary necessity. Written notice must be submitted at least 72 hours prior to departure and approved by the Company.
Approved items:
• Must be limited to the individual
• May not be shared
• Must be reasonable in quantity
One sealed personal water container (<64 oz) per guest permitted.
10.5 Weapons & Open Flame.
Weapons, fireworks, open flames, and hazardous devices are prohibited.
10.6 Smoking & Vaping.
Smoking prohibited unless expressly authorized. Vaping permitted only in designated outdoor areas at Captain’s discretion.
10.7 Environmental Protection.
No dumping of any material overboard.
10.8 Behavior.
Unsafe, reckless, or harassing conduct results in termination without refund.
10.9 Footwear.
High heels and hard-soled shoes must be approved/removed prior to boarding.
10.10 Minors.
Children must be supervised at all times. The Captain may require minors to wear flotation devices.
10.11 Restricted Areas.
Engine room, lazarettes, mechanical compartments, and crew-only areas are strictly off-limits.
10.12 Climbing & Elevated Structures.
Use of ladders, towers, or elevated structures is at guest’s own risk.
11. Third-Party Vendors & Special Services
11.1 All vendors require prior written approval.
11.2 Vendors must be at least eighteen (18) years of age.
11.3 Vendors must provide a Certificate of Insurance (COI) upon request.
11.4 Vendors must carry minimum $1,000,000 per occurrence liability coverage.
11.5 Overkill Yacht Charters LLC must be named as Additional Insured.
11.6 Charterer indemnifies Company for vendor-related claims.
11.7 Electrical equipment must be disclosed and approved.
12. Animals
Animals are prohibited except legally recognized service animals. Emotional support animals are not permitted.
13. Noise & Amplified Sound
13.1 All amplified sound must comply with harbor and municipal regulations while within regulated waters.
13.2 Outside regulated waters, sound levels remain at the Captain’s discretion.
13.3 The Captain may reduce or suspend amplified sound at any time.
14. Liability & Indemnification
14.1 Charterer assumes financial responsibility for damage caused by themselves or guests.
14.2 Charterer agrees to indemnify and hold harmless Overkill Yacht Charters LLC, its owners, officers, and crew from claims arising from guest conduct or vendor activity.
14.3 All guests must execute required liability waivers prior to departure.
